New FDA Nutrition Fact Panel and Added Sugars

In May 2016 the FDA published the final rule on the new Nutrition Facts label which will require the declaration of added sugars. The compliance date for larger manufacturers ($10 million or more in annual sales) will be January 1, 2020, and for smaller manufacturers (less than $10 million in annual food sale) will be January 1, 2021.

The FDA is defining “added sugars” as sugars that are either added during the processing of foods, or that are packaged as such, and include sugars (free, mono- and disaccharides), sugars from syrups and honey, and sugars from concentrated fruit or vegetable juices that are in excess of what would be expected from the same volume of 100 percent fruit or vegetable juice of the same type.

The new rule requires the nutrition label to bear “Total Sugars” in place of “Sugars” and “Includes ‘X’g Added Sugars,” indented directly below “Total Sugars.” Details can be found in the Code of Federal Regulations (21 CFR 101.9).

 Single-ingredient packages and/or containers of pure honey, pure maple syrup, and other pure sugars and syrups are not required to declare “Includes ‘X’g Added Sugars” but must still include the percent Daily Value (DV) for added sugars on their labels with an additional footnote describing the amount of sugar, in grams, added to the diet by one serving and its contribution to the percent DV for added sugars in the diet.

Therefore, food with an added sugar as an ingredient will require “Total Sugars” and “Includes ‘X’g Added Sugars” declarations. If the product is a single-ingredient sweetener itself, it will require “Total Sugars” and the percent Daily Value (DV) for added sugars.
